Terms & Conditions

These terms apply to all bookings with Saving Nemo. By paying a deposit, you agree to the terms below. If anything is unclear, please get in touch before booking.

About us

  • Saving Nemo is the trading name of Saving Nemo Limited, a company registered in England and Wales (company number 11456468). Our registered office is 147 Station Road North, Chingford, London, E4 6AG.
  • You can contact us on 07734 328812 or at contact@savingnemo.co.uk.
  • When we use the words "writing" or "written" in these terms, this includes emails.

Your booking

  • A contract between you and us comes into existence when we confirm your booking in writing.
  • If we cannot accept your booking, for example because we are already booked on your date, we will tell you and will not charge you.
  • If you want to change your booking, please contact us. We will tell you whether the change is possible and about any change to the price or timings, and ask you to confirm before we go ahead.
  • Every menu is tailored to your event. If we need to make a significant change to your menu or these terms, we will tell you before it takes effect.

Wedding and event catering

  • A 25% deposit is required to secure your wedding date.
  • If your guest numbers go down, the price does not reduce. If they go up, additional guests are charged per head.
  • Payment dates, cancellation terms and final numbers are set out in your wedding contract.

Private chef bookings

These terms apply to private chef bookings, not to weddings or large events with street food or a hot buffet.

  • All guests (excluding those with allergies or specific dietary requirements) must select the same menu choices, unless agreed in advance.
  • Jess will travel a maximum of 2 hours from Bishop Auckland. Popular areas include the Lake District, Northumberland and Whitby.
  • Prices start from £55pp for family style and £65pp for a sit-down meal. All quotes are bespoke to cover preparation time, travel time and any other staff required. Canapés or an additional course can be added for £6pp.
  • Menus are based on a minimum of 6 guests, with no maximum. Gatherings of fewer than 6 are possible but subject to a minimum booking fee.
  • A 50% deposit is required to secure the booking, with the balance due 2 weeks before the booking date.
  • Cancellations made 4 weeks or more before the booking receive a 100% refund of the booking fee.
  • Cancellations made 2 to 4 weeks before receive a 50% refund of the booking fee. If only the 50% deposit has been paid, no refund is due.
  • Cancellations made within 2 weeks are non-refundable.
  • Payment is by BACS. Card payments carry a 2.6% fee.
  • Jess will usually arrive 1 to 2 hours before guests to set up the table and kitchen, so please make sure she can get into the property.
  • Jess sources all ingredients.
  • Minimal preparation is done in your kitchen, but some free fridge and freezer space may be needed.
  • Jess cooks with the utensils and equipment at the property, and all menus are served on the property's crockery.
  • Jess takes care of the clean-up and leaves your kitchen spotless at the end of the evening.
  • Jess can recommend tablescape companies and beauty therapists. She receives no commission for this.
  • Wine pairing can be added for an additional fee.

Allergies and dietary requirements

  • All our food is 100% plant-based.
  • Please tell us about any allergies or dietary requirements when you book.

Your right to cancel

  • Because our catering is booked for a specific date, the 14-day cancellation period under the Consumer Contracts Regulations 2013 does not apply. Our cancellation terms for each type of booking are set out above.

Price and payment

  • The price of your booking will be the price we confirm to you in writing.
  • We are not currently VAT registered. If we become registered and the rate of VAT changes between your booking date and your event, we will adjust the VAT you pay, unless you have already paid in full.
  • Despite our best efforts, a price may occasionally be wrong. If the correct price is lower, we will charge the lower amount. If it is higher, we will contact you for your instructions before confirming your booking.
  • If you do not pay by the due date, we may charge interest on the overdue amount at 2% a year above the Barclays Bank PLC base rate, accruing daily until payment.
  • If you think an invoice is wrong, please tell us promptly. You will not have to pay interest until the dispute is resolved.

Photography

  • We may sometimes bring a photographer to capture the dining experience. Their photos and videos are for our use only and may not be used or shared by guests without our written permission.
  • We're happy to take group photos on your own phone or camera after the service has finished.

Events outside our control

  • Neither party is liable for any breach of its obligations caused by events beyond its reasonable control. These include acts of God, fire, natural disaster, death or serious injury or illness of a close family member, breakdown or car accident, injury or illness of the caterer, war or military hostilities.
  • Each party will notify the other immediately on becoming aware of such an event, with details of the circumstances.
  • In bad weather we will try to still provide the service. This may mean a different service time or day, delivery of the food or an alternative caterer. If none of these is possible, we will give a full refund within 28 days.
  • If our vehicle breaks down, serving times may need to move back. We will give as much notice as possible, and no compensation is given for later serving times. If the vehicle cannot be repaired at the roadside, we will try to find another caterer or provide a takeaway from a local business. If neither is possible, we will give a full refund within 28 days.

Our responsibility for loss or damage

  • If we fail to comply with these terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breaking this contract or failing to use reasonable care and skill. We are not responsible for loss or damage that is not foreseeable.
  • We do not exclude or limit our liability where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or that of our employees, agents or subcontractors, and for fraud or fraudulent misrepresentation.

Your personal information

  • We will only use your personal information as set out in our Privacy Policy.

Other important terms

  • We may transfer our rights and obligations under these terms to another organisation. We will tell you in writing if this happens and make sure it does not affect your rights. If you are unhappy with the transfer, you may end the contract within 4 weeks of us telling you and we will refund any payments made for services not yet provided.
  • You may only transfer your rights or obligations under these terms to someone else if we agree in writing.
  • This contract is between you and us. No other person has any rights to enforce any of its terms.
  • If a court finds part of these terms unlawful, the rest will continue in force.
  • If we delay in enforcing these terms, we can still enforce them later.
  • These terms are governed by English law, and you can bring legal proceedings in the English courts. If you live in Scotland, you can bring proceedings in the Scottish or English courts. If you live in Northern Ireland, you can bring proceedings in the Northern Irish or English courts.
